H1B vs. J1 visas (READ THIS before posting a question on visas)

1) For most international scholars, the choice of visa is made without much knowledge of its implications. To alleviate this problem, the NPA (National Postdoc Assoc.) has come up with a detailed 20-page report on the differences between and H1B and J1 visas: NPA Quick Guide to Visas and Immigration Status for International Postdocs .

2) If you are a potential international postdoc and have not yet made a decision on doing a postdoc in the US, please also consider the following document carefully:
NPA International Postdocs - What to ask before accepting a US postdoc position.

3) If you just arrived here, please note that the first people to contact about a visa is always your department and the Dashew Center for International Students and Scholars (formerly Office of International Students and Scholars or OISS).

4) In addition to the information required from you, listed at the Dashew Center link above, it is handy to know what they require from your deparmental personnel. These and relevant contacts are listed for each visa category under the "Resources" tab.

Please read the above documents carefully before accepting a position or deciding on a visa and if you still have questions, go ahead and post a new topic in this forum.

Cheers!

Notice of USCIS Processing Delays for New H-1B Petitions

On April 1, 2006 U.S. Citizenship and Immigration Services changed the procedures for filing new H-1B cases. The changes were the first phase of the USCIS initiative to use centralized filing and bi-specialized adjudication.

This means that now all new H-1B cases that are also change of status cases (COS), i.e. changing from F-1 or J-1 status to H-1B, must be filed with the Vermont Service Center instead of the California Service Center.

In the early weeks after this change we experienced an expected delay in the approval times for these cases. We expected the processing times to become shorter by early summer. Unfortunately, this has not occurred, and it seems that a new H-1B COS case will continue to take four (4) to five (5) months to get an approval. (In the past when our cases were adjudicated at the California Service Center the approvals took only about three months.)

Please notify your P.I.s, faculty and administrators that for the foreseeable future any new COS H-1B cases should be sent to OISS no later than six (6) months prior to the requested H-1B start date if they wish to avoid premium processing. If you have any questions please contact Sylvia, Pat or Ping in OISS.
