Hi - I am on a J-1 visa and my employer just applied for my H1b visa which has been approved. My J1 expires in August and I have to go back to my country to get the visa stamped in my passport. I believe I cannot return to the USA until September 15th, and cannot start work until October 1st. I am in the education field. My employer used a lawyer to apply for the H1b premium processing.

HI every one
I am on j1 visa and trying to get my H1.
Well, It is possible to get h1 if you have the waiver . You cannot change to any other visa if you dont have the waiver, atleast the favorable recommendation from DOS. Once you have the waiver, you can always request for change of status within the US ( you need not go out of US)before you current visa expires.

This is the information i got from my personal research. This may not be appropriate. I recommend you the www.immigrationportal.com. I found this site to be very informative. All the best.

You need to request a waiver from the government of your country and apply H1B. In principle, it is not necessary to travel back to our own country to have the switch done. It will take a long time.

Hi,
I am not sure you can "convert" a visa. I had a J2 visa and i had to file a new application to have an H1 visa. It takes a lot of time now, more than 6 month. Also, this include a trip back to your country since the Visa itself will be given by an american embassy/consulate.
I suggest you talk to your PI now to start the process. It might also be a good idea to hire a lawyer to speed up the process ($3000 on average). you can also pay a $1000 fees to the IRS to move your application from the bottom to the top of the pile (yeah, this is what i call corruption made legal).
Be aware also that for an H1 visa, the american embassy will ask for an interview which can take several weeks to schedule. In other terms, you may be stuck in your country for a while waiting to be interviewed.
All of this is based on my own experience, and it might be different in your case.
email me if you need more info

Please advise.

For converting J1 to H4 visa you need to have the waiver for the 2 year HRR ...if you do not have 2year home country rule then u can apply...
